While every effort is made to ensure quality and safety, the company **disclaims liability for any injuries, damages, or losses** resulting from improper installation, unauthorized modifications, or external environmental factors.

## **3. Limitation of Liability**

In no event shall *Walking Waters*, its affiliates, employees, or partners be liable for:

- Any direct, indirect, incidental, or consequential damages arising from the purchase or use of capsule units or floating homes.

- Losses related to delays in delivery, installation errors caused by third-party contractors, or defects resulting from user negligence.

- Environmental impacts or structural vulnerabilities due to extreme weather conditions.

## **4. Warranty and Repairs**

Each capsule unit and floating home comes with a **limited warranty**, covering:

- Manufacturing defects for a specified period.

- Structural issues arising from production faults.

Warranties do not cover damage from external elements, modifications made by unauthorized personnel, or negligence in use.

## **5. Delivery and Installation**

Delivery timelines are estimated and subject to change due to unforeseen circumstances. *Walking Waters* is **not responsible** for delays caused by third-party carriers, government regulations, or acts of nature. Customers must inspect products upon delivery—claims for damages must be submitted within **48 hours** of receipt.

## **6. Indemnification**

By purchasing and using *Walking Waters* capsule units or floating homes, the customer agrees to indemnify and hold harmless the company from any claims, liabilities, or expenses arising from misuse, non-compliance with local building codes, or unauthorized resale.

## **7. Dispute Resolution**

All disputes will be resolved through **mandatory arbitration**, rather than litigation. Arbitration will be conducted in accordance with the rules set forth by [American Arbitration Association]. Customers waive their right to file lawsuits in any jurisdiction.

## **8. Governing Law**

# **Payment Terms and Conditions**

## **1. Pricing and Payment Methods**

- The total price per *Walking Waters* capsule home or floating home are as listed on website. Prices are subject to change. Prices may vary on custom orders and depending on quantity of units purchased.

- Payments can be made via **bank transfer, credit card, or financing options** through approved partners.

- All transactions must be processed securely through the official *Walking Waters* payment gateway or directly with Walking Waters sales team associate.

## **2. Deposit and Payment Schedule**

- To secure a custom unit, customers must place a **non-refundable deposit** of **$10,000** , afterwhich production will be confirmed. After confirmation half the amount of the unit cost is due to begin construction. Once construction is completed - buyer has 30 days to pay remaining balance. If not paid within 30 days, buyer is subject to lose deposit and be subject to any penalty.

- The remaining balance must be paid in full **before shipment** unless financing arrangements are in place. Then it is when lender pays amount due.

- If financing, customers must adhere to the terms set forth by the lending institution.

## **3. Financing and Installment Plans**

- *Walking Waters* partners with financial institutions to provide **structured payment plans** for eligible buyers.

- Interest rates, repayment terms, and loan approval are **subject to the lender’s discretion**.

- Customers opting for financing are responsible for meeting lender requirements.

-Walking Waters is in no way responsible for payments through lenders. And can not adjust or change any payment options made through lenders.

## **4. Refunds and Cancellations**

- Deposits are **non-refundable**, except in cases where *Walking Waters* fails to deliver due to unforeseen circumstances.

- Payments may be refunded **only if cancellation occurs within 14 days** of purchase and prior to processing for shipment.

- Refunds do **not** cover transaction fees or third-party financing costs.

## **5. Late Payments and Penalties**

- Late payments are subject to a **5% fee per month** on outstanding balances.

- Failure to complete payments within the agreed-upon timeline **may result in cancellation of the order** without refund.

- Any disputes regarding payment issues must be addressed through *Walking Waters’* customer service within **30 days** of the issue.

## **6. Ownership Transfer**

- Ownership is transferred to the customer **only after full payment is received**.

- *Walking Waters* retains the right to **withhold delivery** until payments are completed.

## **7. Payment Security**

- Transactions are processed through **encrypted and secure payment gateways**.

- *Walking Waters* **does not store customer payment details** and complies with financial security regulations.

## **8. Dispute Resolution**

- Payment disputes must be resolved through **mandatory arbitration**.

- Customers waive their right to litigation in favor of binding arbitration under [American Arbitration Association].
